Terms of Use

These terms
Aquifera is an app for iPhone made by Martin Rohr, an individual developer in Prague, Czechia (“I” and “me” below). By installing or using Aquifera you agree to these terms. If you do not agree with them, please do not use the app.
Your licence
Aquifera is distributed through Apple’s App Store. Your licence to use it is Apple’s standard Licensed Application End User License Agreement, and these terms add to it: for anything about the App Store the standard agreement applies, and for the app itself these terms do. Apple is not a party to these terms and has no obligation to maintain or support the app; that is my responsibility.
Not medical advice
Aquifera helps you record what you drink and when you go to the bathroom, and shows you patterns in it. It is not a medical device, it gives no medical advice, and it does not diagnose, treat or prevent anything.
The figures it shows for hydration, caffeine, alcohol and calories are estimates, based on the type and volume of a drink and on averages. How long caffeine or alcohol stays in your body is an estimate too, and everyone is different. A daily goal the app suggests is a general guideline, not a prescription.
The Bladder & Bowel Diary helps you record what a doctor may ask for. It does not replace the visit. If you are worried about your health, talk to a doctor.
Your data
What you log is yours and stays with you. The privacy policy says what the app stores and where. You are responsible for keeping a backup, for example through iCloud or a device backup, and for what you do with the reports and files you export.
Using the app
Use Aquifera for yourself and within the law. Do not try to take the app apart, copy it, sell it, or interfere with the way it works. The app, its name, its icon and its design are mine; nothing in these terms gives you any right to them beyond using the app.
Apple Health
If you connect Apple Health, the app reads and writes Health data as described in the privacy policy and uses it for nothing else. What it writes to Health is what you logged.
Paid features
Aquifera is free. If paid features are added later, they will be sold through the App Store under Apple’s terms, and what they include and cost will be stated before you pay.
Changes
I may change the app, add features or remove them, and I may update these terms. The date at the top shows when they last changed, and the current terms are always on this page. If you keep using the app after a change, you accept the changed terms.
No warranty, limited liability
The app is provided as it is. To the extent the law allows, I give no warranty that it will be free of errors or always available, and I am not liable for indirect loss, lost data or lost profit arising from its use. Nothing in these terms limits the rights you have as a consumer under the law of the country you live in, or any liability that the law does not allow to be limited.
Governing law
These terms are governed by the law of the Czech Republic. If you live in another country of the European Union, you also keep the protection of the mandatory consumer law of that country. Disputes belong to the courts of the Czech Republic, unless the law gives you the right to the courts of your own country. As a consumer in the Czech Republic you can turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) for out-of-court settlement of a dispute.
